These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of the website https://avsystemtech.com/ (the “Site”) operated by AV Systems & Technology Inc. (“we”, “us”, “our” or “Company”), as well as any consultations, quotes, installations, smart home/AV services, and future online purchases through our Site.
By accessing, browsing or using the Site, or by submitting any inquiry, consultation request or purchase, you agree to be bound by these Terms. If you disagree with any part of the Terms, you must not access or use the Site.
1. Use of the Site You must be at least 18 years old to use the Site. You agree to provide accurate, current and complete information when submitting forms (e.g., “Request Consultation”) or creating an account (once implemented). You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.
2. Services We provide professional installation and consulting services for smart home systems, structured cabling, security systems, audio/video distribution, motorized shades, access control, and related AV technologies. Services are quoted and performed based on site visits, client requirements and written proposals. Any descriptions or images on the Site are for illustrative purposes only and do not constitute a binding offer.
Future e-commerce features (via WooCommerce) will allow purchase of products or service packages; separate purchase terms may apply at checkout.
3. Consultations and Quotes Free consultations are introductory only. Quotes are estimates based on information provided and are valid for the period stated (usually 30 days). We reserve the right to adjust pricing due to changes in scope, materials costs, site conditions or unforeseen issues.
4. Payments For services: A deposit (typically 50–60%) is required to schedule design/site work and procurement. Remaining balance is due upon completion or in agreed milestones. Future online purchases via WooCommerce will require full payment at checkout via supported gateways. All payments are non-refundable except as expressly stated in a signed proposal or these Terms.
5. Installation and Completion Installation dates are estimates and subject to availability, weather, permits and client preparation (access, power, etc.). We are not liable for delays beyond our reasonable control. Upon completion, client acceptance occurs unless written objections are raised within 7 days.
6. Limited Warranty We warrant our workmanship for 12 months from completion (labor only). Manufacturer warranties apply to products (varies by brand). This warranty does not cover misuse, alterations by third parties, normal wear, Acts of God, or client-supplied items. EXCEPT AS EXPRESSLY PROVIDED, SERVICES AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
7. Limitation of Liability To the fullest extent permitted by law, our total liability shall not exceed the amount paid by you for the specific service/product giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential or punitive damages (including lost profits, data loss, business interruption). This limitation applies even if advised of the possibility.
8. Indemnification You agree to indemnify and hold us harmless from claims arising from your breach of these Terms, misuse of services/products, or provision of inaccurate/incomplete site information.
9. Intellectual Property All content on the Site (text, images, logos, designs) is owned by us or our licensors and protected by copyright and other laws. You may not reproduce, modify or distribute without written permission.
10. Termination We may terminate or suspend your access immediately, without notice, for any breach of these Terms. Upon termination, your right to use the Site/services ceases.
11. Governing Law These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.
12. Changes to Terms We may revise these Terms at any time. The updated version will be posted here with a revised “Last updated” date. Continued use constitutes acceptance.
